One Year in Prison Confirmed for Stealing an iPhone at Icónica Concert in Seville

The Provincial Court of Seville has upheld the twelve-month prison sentence for a man who stole an iPhone 13 Pro Max valued at 680 euros during the concert 'El rollo de Scalpers by Icónica' in 2024.

The court considered that the evidence, including testimonies from security guards who recovered the device, is sufficient to overturn the presumption of innocence. The defendant claimed there were no direct witnesses to the theft, but Judge Purificación Fernández highlighted the consistency of the statements and the short time lapse between the theft and the recovery of the phone.

Theft During a Crowded Concert in Seville

The events occurred in the early hours of the concert held at the Icónica venue, where Álvaro de Luna, Taburete, Danna Paola, and the Bresh party performed. The victim, an attendee at the event, noticed her iPhone 13 Pro Max was missing and alerted the security guards, who located the defendant and recovered the device.

According to the ruling from the Criminal Court 4 of Seville, the defendant took advantage of a moment of inattention to steal the phone, valued at 680 euros. In addition to the prison sentence, he was ordered to pay 15 euros for the damage caused to the device during the incident.

Appeal to the Court and Confirmation of the Sentence

The convicted man appealed the decision, arguing that there was no direct evidence of the theft, as no one had seen him take the phone. However, the First Section of the Provincial Court of Seville dismissed the appeal. Judge Purificación Fernández argued that the defendant did not provide a credible explanation of how the phone came into his possession, merely denying the facts and claiming he was assaulted by the security guards.

The court particularly valued the testimony of the security guards, who indicated that some young women alerted them that two individuals were stealing phones. Thanks to the photos taken by the witnesses, the guards identified one of them, who turned out to be the defendant. When intercepted, the iPhone belonging to the complainant fell from him.

Implications for Security at Large Events

This case highlights the importance of coordination between the public and security services at mass events. The swift action of the guards and the cooperation of the attendees were key to recovering the stolen item and apprehending the perpetrator. For attendees at future concerts in Seville, the recommendation is to always keep valuables in sight and, in the event of a theft, to immediately notify security personnel.

The final ruling of the Provincial Court of Seville reinforces the idea that circumstantial evidence, based on temporal coincidence and the lack of an alternative explanation, can be sufficient for a conviction for theft. The defendant must serve the twelve-month prison sentence imposed.
